Terms and Conditions

 

1. Agreement

These Terms & Conditions apply to all photography and videography services provided by [Cinematics by taha] (“we,” “our,” or “us”) to the client (“you” or “the client”). By booking our services, paying a deposit, or signing a booking form or agreement, you confirm that you have read, understood, and accepted these Terms & Conditions.

2. Booking Confirmation

A booking is only confirmed once the required deposit has been paid and we have accepted the booking. The agreed event date, start time, coverage hours, locations, and package details will be confirmed in writing.

3. Payments

The total package price, deposit amount, balance due, and any agreed discounts will be stated in your booking confirmation or invoice.

  • A deposit is required to secure the booking date.
  • The deposit and any stated service charge are non-refundable unless we cancel the booking.
  • The remaining balance must be paid before the event date, unless otherwise agreed in writing.
  • Any extra coverage time will be charged at the agreed hourly rate for each cameraman or photographer.

Failure to make payment on time may result in suspension or cancellation of services.

4. Client Responsibilities

The client agrees to cooperate fully to help us deliver the best possible results. This includes:

  • providing clear event details and timings,
  • informing us in advance of important moments such as speeches, cake cutting, first dance, entrances, or any other key parts of the event,
  • ensuring access to the agreed venues and locations,
  • helping us gather people for group photos or important family shots when needed.

We are not responsible for missed photos or videos where the client, guests, venue staff, or other circumstances prevent us from capturing them.

5. Parking, Access, and Travel

The client must provide suitable parking close to the venue where possible, or cover any required parking charges. We are not responsible for delays caused by lack of parking or difficult access.

Where the event involves multiple locations, the client must provide suitable transport between locations unless otherwise agreed. Travel costs may apply depending on the package and the distance between locations.

For destination shoots, pre-wedding shoots, or locations that require extended travel, additional travel and time charges may apply.

6. Meals During Long Events

For bookings where our attendance is required for more than four hours, the client must provide a meal for each photographer or videographer. Any dietary requirements advised in advance must be reasonably accommodated.

7. Venue Rules and Legal Permissions

The client is responsible for ensuring that the event, venue, and any photoshoot or video shoot locations comply with all applicable rules, regulations, and permissions.

The client must obtain any permission required for photography, videography, or drone use at the chosen location. We are not responsible where a venue, authority, or third party limits, stops, or restricts shooting.

If any fines, penalties, or legal issues arise because the client did not obtain proper permission or gave incorrect instructions, the client will be responsible for those costs.

8. Coverage Limitations

We will make every reasonable effort to capture as much of the event as possible, including guests and important moments. However, results may be affected by:

  • venue restrictions,
  • weather,
  • lighting conditions,
  • guest cooperation,
  • delays in the schedule,
  • interference by other photographers, videographers, suppliers, or guests using mobile phones or cameras.

The client agrees that [Cinematics by taha] will be given reasonable priority to capture key photographs and videos during the event.

9. Editing and Creative Process

All final images and videos are edited in our own professional style. This includes basic colour correction, exposure adjustment, and standard editing.

Any intensive retouching, advanced manipulation, special edits, or extra requests outside the agreed package may be charged separately and may increase delivery time.

Raw or unedited files are not included unless clearly agreed in writing.

10. Delivery Time

Delivery times may vary depending on workload, season, and the type of package booked.

As a general guide:

  • photo and video editing may take 12 to 16 weeks,
  • during peak wedding season, especially May to September, delivery may take up to 6 months.

Delivery timelines may also depend on the client providing all required information, including music selections for video editing where applicable.

11. Music Selection for Wedding Videos

Where video editing requires music selection, the client must send the full song list within 7 days after the wedding, unless another deadline is agreed.

The song list should include music for the main parts of the video, such as:

  • highlights video,
  • preparation shots,
  • ceremony entrance,
  • couple shoot,
  • reception entrance,
  • first dance,
  • and a few additional songs for general use.

If the song list is not provided within the required time, we may use suitable music of our own choice. Once editing has been completed using those tracks, music changes may not be accepted.

Where delivery depends on music being submitted, the editing timeline will begin after the required songs are received.

12. Priority Delivery

Priority delivery may be available as an optional paid service. Where selected, an additional priority fee will apply and the delivery time will follow the agreed priority schedule.

13. Revisions and Corrections

After the initial delivery, the client must review the work and send any requested corrections within the stated review period.

  • One round of reasonable corrections is included free of charge if requested within the allowed time.
  • The number of free changes may be limited according to the agreed package or delivery terms.
  • Requests made after the free revision period may be charged.
  • Additional editing or repeated changes may require extra time and extra payment.

We will try to replace or remove specific shots where requested, but this depends on available material and editing practicality.

14. Storage and Archiving

We keep delivered images, footage, and related files for a limited period only. Unless otherwise agreed, files may be archived for up to 30 days after delivery.

It is the client’s responsibility to download, back up, and safely store all delivered files once received. We are not responsible for lost files after the storage period has expired.

Where USBs, albums, prints, or other physical items are included, only the number of items listed in the package will be supplied. Additional copies will be charged separately.

15. Albums, Prints, and Physical Products

Where an album is included, the client must select and return the chosen photos within the requested time after receiving the edited gallery.

Album design, approval, printing, and delivery may take several weeks after final photo selection is received. Once the album design is approved and sent to print, we are not responsible for later dissatisfaction with the approved design.

Any upgrade in album style, material, size, or print finish may require additional payment.

16. Drone Coverage

Drone coverage will only be provided where:

  • weather conditions are safe,
  • local regulations allow it,
  • venue rules allow it,
  • and all required permissions have been obtained.

We are not responsible if drone use is not possible due to weather, venue restrictions, airspace rules, or lack of permission.

17. Pricing and Future Offers

The package price agreed at the time of booking is final. Any future promotions, offers, discounts, or price reductions introduced after booking will not apply to an existing confirmed booking unless we agree otherwise in writing.

18. Client Conduct

We are committed to treating all clients with professionalism and respect, and we expect the same in return.

Abusive, threatening, insulting, or unacceptable behaviour toward us, our team, or any staff member will not be tolerated. In such cases, we reserve the right to:

  • stop communication,
  • remove ourselves from the event or situation,
  • end the service immediately,
  • refer the matter to a senior team member,
  • terminate the booking or contract without refund where necessary,
  • and report criminal or threatening behaviour to the police or other authorities.

19. Copyright and Personal Use

All photographs and videos remain the copyright of [Cinematics by taha]unless otherwise agreed in writing.

The client is granted permission to use the delivered images and videos for personal use only. This includes sharing with family and friends and posting on personal social media accounts.

The client may not sell, publish commercially, submit to media outlets, use for advertising, or exploit the images or videos for business purposes without our prior written consent.

Where photos or videos are posted online, we request that the client tags or credits [Cinematics by taha] where possible.

20. Cancellation by Client

The client may cancel the booking at any time before the event by giving written notice.

Unless otherwise stated in the booking agreement:

  • the deposit and service charge are non-refundable,
  • where cancellation is made well in advance, only the deposit may be retained,
  • where cancellation is made closer to the event, a percentage of the total package value may be charged,
  • where cancellation is made very close to the event date, a higher percentage of the total package value may be due.

The exact cancellation charges should match the client’s booking confirmation or signed agreement.

21. Cancellation by Us

In the unlikely event that we must cancel, we will make reasonable efforts to provide a suitable replacement professional, subject to the client’s written approval.

Where no suitable replacement is accepted or available, we will refund all monies paid, including any non-refundable service charge.

22. Equipment Failure and Technical Issues

While we use professional equipment and take care to protect all images and footage, no digital system is completely risk-free.

In the event of equipment malfunction, data corruption, memory card failure, file damage, or another technical issue, we will make reasonable efforts to recover the material. However, we are not liable for partial or complete loss of data, delays caused by recovery attempts, or any loss resulting from technical failure.

The client acknowledges that photography and videography services carry an unavoidable risk of technical problems beyond our control.

23. Limitation of Liability

Our liability for any claim, loss, or dispute arising out of the services provided will be limited to the total amount paid by the client under the relevant booking, except where the law requires otherwise.

We will not be liable for indirect loss, emotional distress, missed moments caused by events beyond our control, venue restrictions, weather conditions, guest interference, or delays caused by the client or third parties.

24. Dispute Resolution

If a dispute arises, both parties agree to first try to resolve the matter through discussion in good faith.

Where a dispute cannot be resolved informally, both parties agree to attempt mediation before taking legal action. If legal proceedings become necessary, the successful party may seek recovery of legal costs where permitted by law.

25. Severability

If any part of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remainder will continue in full force and effect.

26. Entire Agreement

These Terms & Conditions, together with any booking form, invoice, package details, and written agreement between the parties, form the entire agreement between the client and [Cinematics by taha].

Any amendment or addition must be agreed in writing by both parties.
